Authority duties and responsibilities

 

Legal Consultancy is obliged to perform the following duties in accordance with article 35 of the Decree Law on Higher Education Institutions and the Administrative Organization of Higher Education Institutions:

a) To defend the rights of the University in judicial and administrative authorities in their disagreements and disputes with the students, other persons and institutions of the University,

b) To assist the administration in the execution of the University`s savings in accordance with the laws in force,

c) To fulfill other assigned duties.


According to Article 4 of the Decree Law on the Execution of Legal Services in Public Administrations and Special Budget Administrations within the Scope of General Budget No. 659, he is obliged to perform the following duties:

(1) Legal Consultancy; It is responsible and responsible for carrying out the works and procedures related to judicial services and legal counseling in administrations.

(2) Within the scope of legal advisory services;

a) Represents the administration in judicial and administrative cases to which the administration is a party, in internal and external arbitration proceedings, enforcement proceedings and any other legal disputes submitted to the judiciary and follows the proceedings and enforcement proceedings as a proxy.

b) Coordinates, monitors and inspects the proceedings related to litigation and enforcement and arbitration to be represented by the administration through the purchase of services.

(3) Legal Consultancy within the scope of legal consultancy;

a) Examines legislative drafts prepared by other public institutions and organizations related to administrative services, legislative drafts prepared by administrative units, any contract and specification drafts to be issued, works related to disputes between the administration and third parties, and other legal inquiries to be asked by the administrative units. .

b) Takes legal measures to prevent disputes in a timely manner and gives opinion on settlement of disputes through peace.

c) It prepares the necessary legal proposals in order to realize the objectives of the administration better and to ensure that they work in accordance with the legislation, plan and program.

(4) Legal Consultancy carries out the secretariat services of the legal dispute evaluation commission and other duties assigned by the administration.

Depending on the duties specified in Article 35 of the Decree Law No. 124 and Article 4 of the Decree Law No. 659, the job descriptions of our employees are as follows:

1) To assist the administration in the execution of the University`s savings in accordance with the legislation in force,

2) To submit opinions by examining the draft legislation prepared by other public institutions and organizations, the draft legislation prepared by other units of the University, and any draft contract and specification draft,

3) To follow and finalize all kinds of lawsuits and enforcement proceedings to which the university is a party, before the judicial and administrative jurisdictions and enforcement offices,

4) Providing legal opinions on the issues requested by the Rectorate and General Secretariat and other units of the University,

5) To distribute work and duties among the unit staff and to ensure coordination,

6) To issue warnings, notices on behalf of the institution, to notify and respond to notices to be made to the Institution from judicial and administrative judicial authorities, enforcement offices and notaries,

7) To check the compliance of disciplinary investigations and punishments given as a result of the law with the law,

8) To ensure that the cases and files within its body are regularly created, followed up and finalized, and controlled,

9) To take part in the Legal Dispute Assessment Commission as a member,

10) To perform other duties assigned by the Rectorate and the General Secretariat in legal matters.

Powers, Duties and Responsibilities of the Lawyer

1) To follow up and conclude all kinds of judicial and administrative cases, enforcement proceedings and arbitration matters to which our university is a party, before the courts, arbitrators and enforcement offices,

2) To issue warnings, notices on behalf of the institution, to notify and respond to notices to be made to the Authority from judicial and administrative judicial authorities, enforcement offices and notaries,

3) To prepare a legal opinion in the works assigned to him for review by the Legal Counsel,

4) To prepare correspondence regarding disciplinary investigations opened by administrative and academic staff and students, to check the compliance of disciplinary investigations made by other units with the law,

5) To attend the legislation commission meetings as a member and to express an opinion,

6) To participate in the special commission works he / she is assigned to represent the Legal Counsel,

7) To perform other duties assigned to him by the Legal Counsel.

Executive Secretariat

1) To carry out secretarial services,

2) Following the hearing days, delivering the case files to the lawyer who will enter the hearing,

3) Keeping records of incoming and outgoing documents,

4) To process the lawsuits and follow-ups opened in the case book, decision book and index,

5) To file the documents,

6) To perform other duties assigned to him by Legal Counsel and Lawyer.

Editorial Affairs

1) To make correspondence about judicial, administrative cases and enforcement proceedings prepared by the lawyers of our university and to which our university is a party,

2) To make correspondence of disciplinary investigations about administrative and academic staff and students,

3) To notify the confidential and urgent notifications to people in the university,

4) To perform the accrual works of the unit,

5) Prepare and deliver the files that will go to the archive of the institution,

6) To record the lawsuits and proceedings filed on the computer,

7) To prepare the annual activity reports of the unit,

8) To send the Official Newspaper to the relevant people via e-mail,
9) Determining the shortage of material and obtaining it from the relevant unit,
10) To perform other duties assigned by Legal Counsel and Lawyers,
